Preamble

These Terms and Conditions govern the use of the Daylivro platform, accessible via mobile application (iOS and Android) and website. Daylivro is a local delivery platform operating in Marrakech, Morocco, in accordance with the Dahir forming the Code of Obligations and Contracts (DOC) and Law No. 53-05 on electronic exchange of legal data, amended by Law No. 43-20.

Article 1 - Object and Scope

Daylivro allows Users to order products from partners and benefit from home delivery. The Platform is limited to Marrakech in small-scale production phase. Services included: meal and food product orders, grocery orders via D-Market, valid and enforceable electronic contracts.

Article 2 - Account Creation

To use the Platform, you must create an account by providing your personal information (name, email address, phone number, delivery address). Creation is free and accessible via App Store (iOS), Google Play Store (Android) or web/mobile browser. Email or SMS validation required.

Article 3 - Order Placement

  • Select a partner, add items to cart, indicate your address and choose payment method.
  • Product photos are illustrative and non-contractual. No advance scheduling is possible. Partners may contact you for clarifications.

Article 4 - Delivery

  • Estimated times: 15-45 minutes for meals once ready, up to 1 hour for D-Market depending on distance and availability.
  • Delivery fees variable according to distance, free at certain partners above a minimum. Real-time tracking via the application for D-Market.

Article 5 - Payment

  • Accepted methods: cash on delivery or bank cards (CMI, Visa, Mastercard).
  • For D-Market: <300 DHS payment on delivery, >301 DHS delivery person collects money before the trip (except regular customers). Refund within 15 days in case of unavailability.

Article 6 - User Rights and Obligations

  • Obligations: provide accurate information, be patient during deliveries, respect partners and delivery personnel.
  • Right of withdrawal: 7 days for distance contracts if not executed, with refund (Articles 36-38, Law No. 31-08).

Article 7 - Responsibility

Daylivro is not responsible for delays due to force majeure (weather, road incidents) or User fault (DOC, Article 269). Limited liability for product defects; partners guarantee quality (DOC, Article 532).

Article 8 - Dispute Resolution

Any dispute is subject to Moroccan law, Marrakech jurisdiction (consumer choice possible, Article 202, Law No. 31-08). Contact support via the application; mediation possible via consumer associations.

Article 9 - Intellectual Property

All content present on the Daylivro Platform (texts, images, logos, trademarks) is protected by intellectual property rights. Any unauthorized reproduction is prohibited.

Article 10 - Terms Modification

Daylivro reserves the right to modify these terms at any time. Users will be informed of modifications by notification on the application or by email.
